1. Introduction

Welcome to MobileWala.com, operated by Globein Trading USA LLP. These Terms of Service ("Terms") govern your access to and use of the MobileWala.com platform, including any related services, auctions, and features. By creating an account or using our platform, you agree to be bound by these Terms.

2. Eligibility

You must be a legally registered business entity in the United States to use our B2B platform. By registering, you represent that:

• You are a legitimate business entity authorized to transact
• You have the legal authority to bind your business to these Terms
• All information provided during registration is accurate and complete
• You are not located in a jurisdiction where our services are prohibited

3. Account Registration

Each business entity may maintain one account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Auction Participation

By participating in auctions on MobileWala.com, you agree:

• All bids are binding commitments to purchase
• Bid retractions are not permitted except in cases of technical error
• You have inspected or waived inspection of device grading standards
• You will not manipulate auction outcomes or engage in collusive bidding
• Winning bids must be paid within the specified payment window

5. Payment Terms

Payment is due within 48 hours of winning an auction. Accepted payment methods include wire transfer, ACH, and approved credit terms for qualified buyers. All prices are in USD. Late payments may incur a 1.5% monthly finance charge and account suspension.

6. Shipping & Risk of Loss

Shipping costs are borne by the buyer unless otherwise specified. Risk of loss transfers to the buyer upon delivery to the carrier. Insurance is included in shipping costs up to the invoice value. Claims for damage during transit must be filed within 48 hours of delivery.

7. Returns & Refunds

Returns are accepted within 48 hours of delivery under our Refund Policy. Devices must be in the same condition as received. Refunds are processed within 5-7 business days after inspection. Custom lots and devices listed "as-is" are non-returnable.

8. Limitation of Liability

MobileWala.com and Globein Trading USA LLP shall not be liable for indirect, incidental, or consequential damages arising from the use of our platform. Our total liability is limited to the purchase price of the specific devices in question. We do not warrant uninterrupted or error-free platform operation.

9. Indemnification

You agree to indemnify and hold harmless MobileWala.com, Globein Trading USA LLP, and their affiliates from any claims, damages, or expenses arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

10. Termination

Either party may terminate this agreement with 30 days written notice. We may immediately terminate or suspend your account for breach of these Terms, fraudulent activity, or conduct that harms our platform or other users. Upon termination, all outstanding obligations remain payable.

11. Governing Law

These Terms shall be governed by the laws of the United States and the State of Delaware. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use of the platform after changes constitute acceptance of the updated Terms.
